Terms of Service

The agreement between your organization and Eleserv Softech Pvt Ltd for using Customer360.

These Terms of Service ("Terms") govern access to and use of Customer360 (the "Service") provided by Eleserv Softech Pvt Ltd ("we", "us"). By creating an organization or using the Service, you agree to these Terms on behalf of that organization ("Customer", "you"). If you do not have authority to bind the organization, do not use the Service.

1. The Service

Customer360 provides website analytics, consent management, visitor intelligence, engagement tools (popups, spin wheel, short links), integrations and reports. Features and limits depend on your plan or licence. We may improve or change features; we will not materially reduce core functionality of a paid plan during a paid period.

2. Accounts and security

  • You are responsible for the accuracy of your organization's details and for everyone you invite.
  • Keep credentials confidential and enable two-factor authentication for administrators. Tell us promptly about any unauthorised access.
  • You may only install the tracking script on websites and domains you control and have verified.

3. Your obligations for visitor data

  • You are the data controller ("data fiduciary" under India's DPDP Act) for data collected from your websites' visitors. We process it on your behalf as described in the Data Processing Addendum.
  • You must provide your visitors with a privacy notice and obtain any consent required by law. The consent banner helps, but configuring it correctly for your audience is your responsibility.
  • Do not send passwords, payment card data, government ID numbers, health data or other sensitive personal data to the Service, and do not use it to track children under 18 where consent from a parent is required but not obtained.

4. Acceptable use

  • No unlawful, deceptive or harassing content in popups, links or messages.
  • No attempts to breach security, probe other tenants, overload the Service or bypass limits or licence checks.
  • No reselling or providing the Service to third parties except as permitted by your plan or a written agreement.
  • Short links must not point to malware, phishing or unlawful content; we may disable such links without notice.

5. Plans, invoices and payment

  • Trials are free for the stated period. Paid plans are billed in advance per the plan and interval you request.
  • We issue tax invoices (GST applied where applicable). Payment is made by bank transfer or UPI by the due date on the invoice.
  • Fees are non-refundable except where required by law or stated in writing. If an invoice remains unpaid after the grace period, we may suspend the Service after notice.
  • Going over monthly event limits does not stop tracking; we will notify you and may ask you to move to a suitable plan.

6. Self-hosted edition

If you run the self-hosted edition, you are responsible for the infrastructure, security, backups and updates of your installation. The licence key is personal to the licensee, may be bound to one hostname and must not be shared, modified or circumvented.

7. Your data

You own your data. You can export reports at any time. When your subscription ends, dashboards remain readable for a limited period; afterwards we delete your organization's data in line with the Privacy Policy and DPA, except where we must keep records by law (for example invoices).

8. Availability and support

We aim for high availability and to fix problems quickly, but the Service is provided without a guaranteed uptime unless agreed in writing. Planned maintenance is announced where practical.

9. Confidentiality and intellectual property

Each party keeps the other's non-public information confidential. We own the Service, its software and documentation; you receive a non-exclusive, non-transferable right to use it during your subscription. Feedback you give may be used to improve the Service.

10. Warranties and liability

  • The Service is provided "as is" to the extent permitted by law. Analytics are estimates and may differ from other tools.
  • Neither party is liable for indirect or consequential losses, lost profits or lost data beyond what reasonable backups would have prevented.
  • Our total liability in any 12 months is limited to the fees you paid us in that period.
  • Nothing limits liability that cannot be limited by law.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for material breach of these Terms, non-payment, or where required by law, with notice where practical.

12. Changes, law and disputes

We may update these Terms; material changes will be notified in the Service or by email at least 15 days before they apply. These Terms are governed by the laws of India, and the courts at the place of our registered office have exclusive jurisdiction.
